On December 30, 2022, at approximately 2201 hours, FTPD officers responded to the area of Mitman Road and Heather Lane for a female who was waving at passing traffic. Upon arrival, officers determined the female was attempting to warn motorists of a vehicle in the north bound lane of Mitman Road that was running with no lights illuminated. Officers checked the vehicle and observed a male driver slumped over the steering wheel, with the vehicle still in "drive". The vehicle suddenly began to slowly move in reverse. Additional officers responded to the scene, where one officer positioned his vehicle against the rear of the defendant's vehicle to prevent it from continuing to move in reverse.
Officers were eventually able to awaken the driver and he was removed from the vehicle. Officers detected an odor of alcoholic beverage emanating from the driver and he was unable to stand without assistance. The driver, who was positively identified as Bryan Richmond, was unable to participate in standardized field sobriety tests. E.M.S. responded to the scene and transported Richmond to the hospital. A legal blood draw was obtained and the results of the test showed Richmond's BAC was .319%. Richmond was charged by criminal complaint with (1 Count) Driving Under the Influence of Alcohol - General Impairment (M) and (1 Count) Driving Under the Influence of Alcohol - Highest Rate (M).
